Planning permission in France

A shed, a pool, solar panels, an extension: French law answers each of those separately, and it answers them by size. Below is what the national code says per object, with the article it comes from. Read the three warnings first, because each of them can cancel the answer for your address.

Three things that cancel the answer

  • A listed setting beats every exemption. The exemptions below do not apply sauf lorsqu'ils sont implantés dans le périmètre d'un site patrimonial remarquable, dans les abords des monuments historiques ou dans un site classé ou en instance de classement. In an old village that is often where the house is.
  • The 40 square metre threshold is local. It exists inside an urban zone of a local plan. Outside one, the figure is 20.
  • Between 20 and 40 can still need the heavy permit, if the finished building would cross another threshold. The article says so itself, in the same sentence.

What each job needs

Three regimes exist, from lightest to heaviest: no formality at all, a déclaration préalable (a notification the mairie can object to), and a permis de construire (a full permit).

The wording itself

Sizes in French law are written out, and the sentence around a number often carries more than the number. These are the lines the table is built on, unchanged.

R421-9 f) · version 2024-11-16. The article says nothing here about a pool basin larger than 100 square metres, and nothing about a cover 1.80 metres high or more. If you are planning either, you fall outside this quote and need to check with the mairie.

R421-2 c) · version 2024-11-16. This quote only covers panels ON THE GROUND. Panels on a roof change the external appearance of the building and so fall under R*421-17 a); that is a different regime, and it was not researched separately here.

R421-17 a) · version 2026-02-22. The quote names two exceptions: ravalement, and the works listed in three paragraphs of article R*. 421-13. What those paragraphs say was not researched for this page.

R421-17 f) · version 2026-02-22. The 40 only applies in an urban zone of a local plan; outside such a zone it stays at 20, and that is exactly where British buyers often buy. And note the end of this quote: it takes the range from 20 to 40 back out as soon as the job crosses a threshold in article R*431-2.

R421-14 a), b) · version 2016-01-01. Note the word toutefois in point b): between 20 and 40 square metres, a permis de construire is still required as soon as the work takes the total of the building over a threshold in article R. 431-2. What those thresholds are is set out in that other article and was not researched here.

What this page does not cover

Naming the gaps is part of the answer. These were not researched for this page, so do not read the table as complete:

  • Panels on a roof. They fall under changing the external appearance, but the separate regime for them was not researched.
  • Pergolas, carports and greenhouses as a category of their own. They fall under the size rules above, but R*421-2 also has its own provisions (for greenhouses, among others) that were not researched for this page.
  • How long the procedure takes. The searches "how long does planning permission take in france" and "how long does planning permission last in france" gave six search suggestions between them, so the question is real; the articles on it were not researched.
  • Permission after the fact. "retrospective planning permission in france" gave five search suggestions and comes up for more than one country in the search data, but the regime for legalising work after the fact is not covered here.
  • What exactly a site patrimonial remarquable and the abords des monuments historiques are. The exception is quoted word for word; where these areas begin and end is not.

Frequently asked questions

Is the 40 square metre threshold the one that applies to me?

Only inside an urban zone of a local plan (a plan local d’urbanisme). Outside such a zone the threshold is 20. A lot of British buyers are outside one, so this is worth checking at the mairie before you design around 40.

My village is listed. Do the exemptions still work?

The exemptions in the article below do not apply inside the perimeter of a protected heritage site, in the surroundings of a historic monument, or in a classified site. That is in the opening line of the article itself, and in an old village that is often where the house is.

Who decides in the end?

The mairie. They hold the local plan, and without that plan half of these thresholds cannot be applied to a specific address. This page prints what the national code says, with the article, and stops there.
